Erika Kirk is urging the judge overseeing the case against Tyler Robinson, the man accused of assassinating her husband, Charlie Kirk, to reject a defense proposal that would push the murder trial into 2029, and to schedule the trial instead for the earliest practicable date in 2027, according to new court documents obtained by Fox News.
In the filing, Kirk's legal team blasted the defense's proposed timeline as "grossly out of line" with comparable cases. Kirk acts in the case as the court-appointed victim representative, a role Utah law gives her in the proceedings against the 23-year-old accused of killing her husband.
The filing comes ahead of a pretrial conference scheduled for Friday, October 23, at 1 p.m. local time in Provo, where Judge Tony Graf is expected to address the trial schedule. Graf had set the conference for that purpose after sending the case to trial, and Kirk's side has asked that a trial date actually be set at it.
It is not the first time Kirk has pressed the court on speed. In January 2026, her attorney, Jeffrey A. Neiman, filed a formal invocation of her rights under Utah Code ยง 77-38-7(2) as victim representative "to a speedy trial" and to a disposition "free from unwarranted delay caused by or at the behest of the defendant." "Nobody believed in the importance of the United States Constitution more than Charlie Kirk," that filing said. "The Defendant in this case is entitled to a fair trial, and he must be given one, but he is not entitled to cause undue delay to the criminal justice process."
The case reached this stage on September 1, when Graf ruled after a multiday preliminary hearing that began in July that prosecutors had presented sufficient evidence for Robinson to stand trial on all seven counts: aggravated murder, felony discharge of a firearm causing serious bodily injury, obstruction of justice, witness tampering, and a violent offense committed in the presence of a child. Defense attorney Kathryn Nester entered not guilty pleas on Robinson's behalf immediately after the ruling. Utah County Attorney Jeff Gray has said prosecutors will seek the death penalty if Robinson is convicted of the murder.
The defense's push for a later trial grows out of the scale of the evidence. In earlier filings, Robinson's attorneys said prosecutors had turned over more than 600,000 files by March 12, that discovery in the case is "incomplete, voluminous, and the processing of it is complex," and that even a single defense expert โ a forensic biologist โ would need six months to review the evidence. The defense has also fought to keep cameras out of the courtroom, arguing that coverage of the case prejudices Robinson.
Charlie Kirk, the 31-year-old founder of Turning Point USA, was shot and killed on September 10, 2025, while fielding questions from an audience at Utah Valley University in Orem, the first stop of his "The American Comeback" tour. Robinson was charged less than a week later. After the September 1 ruling, the Kirk family said the decision marked "an important step in our family's pursuit of justice," and that they remain committed to "a transparent and timely process" โ a process that, on the defense's proposed schedule, would not reach a jury until 2029.
